Clause 1 | General
1.1  The General Terms and Conditions of WeAreLabels (hereafter referred to as the ‘Conditions’) apply to all offers, orders, agreements and deliveries made by or with WeAreLabels. By placing an order you agree to be bound by these Conditions. If you ask, a copy of these Conditions can be sent to you free of charge. It’s also possible to consult these Conditions online via: http://www.wearelabels.com/general-agreement

1.2 It’s only possible to deviate from these Conditions if agreed in writing. In this case all the other provisions remain in effect.

Clause 2 | Agreement and Order
2.1  The agreement becomes binding at the time that you place your order by clicking the ‘Place order’ button on the order form (the last form in the order process, with the item description and billing address). Once your order’s been placed, WeAreLabels processes it by means of the order form on the website.

2.2  You’ll receive an email confirming your order at the email address you’ve given. Even if you don’t receive an email (which we hope won’t happen!), your order still remains in effect.

2.3  WeAreLabels does its best to ensure that the images of the items reflect the reality as accurately as possible. Nevertheless, the images only serve as an indication and aren’t binding on WeAreLabels.

2.4  All prices quoted by WeAreLabels are in euros and include 19% VAT. WeAreLabels is entitled to adjust its prices. The adjustments apply from the time they’re published on the website and don’t apply to items that have already been ordered.

2.5  WeAreLabels is entitled to refuse an order and/or to dissolve the agreement, if there are good grounds for believing that the other party will not (be able to) fulfill its obligations. In these circumstances, WeAreLabels will advise the other party of this within 14 (fourteen) days after the receipt of the order, giving reasons for its refusal. 

Clause 3 | Offers
3.1  All the offers on WeAreLabels are without obligation, unless otherwise specified. WeAreLabels won’t be bound by its offers if you can reasonably be expected to understand that an obvious mistake or written error has been made. It’s not possible to subscribe to offers.

3.2  The prices quoted on the WeAreLabels website include VAT.

3.3  Discount codes published by WeAreLabels can be deactivated at all times and without any reason being given.

Clause 4 | Delivery Costs
4.1  WeAreLabels charges € 4.95 delivery costs for deliveries within the Netherlands. Delivery costs per European country vary, click here to see the rates per destination. Delivery costs to countries outside of Europe are € 22.50.

Clause 5 | Delivery
5.1  When your order is to be delivered within the Netherlands, WeAreLabels does its best to send it within 24 hours of receipt of payment. The item will be delivered no later than 5 days after you ordered it. If this isn’t possible (because, for example, your order is temporarily out of stock) or an order can only be met in part, then you’ll be notified within 48 (forty-eight) hours of the order being placed. In this case you’re entitled to cancel your order without having to pay anything. 

5.2  You’re obliged to take delivery of the purchased items at the time they’re delivered to you.

5.3  If WeAreLabels needs information from you in order to execute an order, then the execution period won’t come into effect until you’ve provided WeAreLabels with the full and correct information it needs.

5.4  If you’ve given WeAreLabels the wrong delivery address, then you’ll have to pay the extra delivery costs yourself. 

Clause 6 | Collection
6.1  Instead of having your order delivered by PostNL you can decide to collect your order from our physical boutique, Another Labels, in Amsterdam. If you decide to do this, you should indicate accordingly when placing your order with WeAreLabels. In this way, you get to save on delivery costs! 

6.2  When you’ve placed your order on a weekday and have received an email confirmation, your order will be ready and waiting for you the next day at:

6.2  If you’ve placed your order during the weekend, then it’ll be ready for you at Another Labels from 4 pm on the succeeding Monday. 

Clause 7 | Shipment and Transport
7.1  WeAreLabels is responsible for damage, theft or loss which occurs during the shipment of the items. The risk passes to you at the time of delivery. 

7.2  WeAreLabels sends packages via PostNL’s parcel post service. You must take delivery of the package(s) in person and sign an acknowledgement of receipt. 

7.3  If you’re not home when the PostNL delivery man calls, he’ll leave a notice with the ‘Not at Home’ code. By logging in to www.postnl.nl/ontvangen and filling in the code, you can indicate yourself when you’d like the package to be delivered. You’ll find detailed instructions on how to do this on the PostNL website. 

Clause 8 | Payment and Payment Methods
8.1  At  WeAreLabels you can choose between 4 (four) safe methods of payment: iDeal, MasterCard, Visa and PayPal.

8.2  Payments using MasterCard, Visa, or iDEAL are processed via MultiSafepay’s  secure procedure. MultiSafepay is one of the most reliable Payment Service Providers in the Netherlands.

8.3  If you choose the PayPal payment option, then your payment will be processed via a secure PayPal connection. 

8.4  WeAreLabels retains full ownership of all the delivered items until such time as the purchase price and any other amounts due to WeAreLabels have been paid in full. 

Clause 9 | ‘Cooling Off’ Period
9.1  WeAreLabels does its best to ensure that its customers are happy with their purchases. If you’re not satisfied with your purchase, you have 14 (fourteen) workdays from the date on which you receive the item to return it, without giving any reason, to:

You can dissolve the agreement or return the items. You need to inform WeAreLabels of this within 14 (fourteen) workdays via the contact form on the website, You then need to fill in the return form and send this back to us with the items you ordered.  

9.2  You yourself are responsible for the cost of returning the items. 

9.3  For reasons of hygiene, swimwear, lingerie and accessories can’t be returned to WeAreLabels.

9.4  It’s only possible to return or exchange items when they’re still in their original packaged state and in their original undamaged packaging, have their (info) tags attached and haven’t been worn or washed. WeAreLabels retains the right to refuse to accept returned items, however this will only happen when, in WeAreLabel’s opinion, an item fails to meet the above conditions. 

9.5  If you want to exchange an item, you need to inform WeAreLabels of this within 14 (fourteen) workdays of its receipt via the contact form on the website. You need to mention that you want to exchange an item, and fill in your customer number and the name and number of the item to be exchanged. You also need to indicate which item you want to receive in exchange. Once we’ve received and checked the item you want to return, we’ll send you the new item. 

9.6  If you want to return an item and get a refund, you need to inform WeAreLabels of this within 14 (fourteen) workdays of its receipt via the contact form on the website.  You need to mention that you want to return an item, and fill in your customer number and the name and number of the item. You also need to fill in the return form for the item you want to return and send this back with the returned item. Once the item has been received and checked, your money, less delivery and packaging costs, will be refunded within 30 (thirty) days.

9.7  You can return your items to our physical boutique;

You first need to notify us via the contact form on the website. You then fill in the return form and take this along with the items you want to return to the boutique. You can return the items to the boutique once. You can’t exchange items there. WeAreLabels doesn’t refund the purchase price in cash. It’ll be credited to your bank account within 30 (thirty) days. N.B.: it’s only possible to return items to our physical boutique, Another Labels, and not to other shops. 

Clause 10 | Liability
10.1  Liability on the part of WeAreLabels for direct or indirect damage caused by an item purchased from it is in any case limited to an amount equal to the selling price of that item, unless and in so far as there has been malice or gross negligence on the part of WeAreLabels.

Clause 11 | Force Majeure
11.1  For the purposes of this clause, force majeure means all shortcomings which cannot be attributed to WeAreLabels.

11.2  If WeAreLabels is unable to meet its obligations due to force majeure, those obligations will be suspended for the duration of the state of force majeure. After 30 (thirty) days both parties have the right to dissolve the agreement either in whole or in part by means of a written declaration, without being entitled to any damages or compensation.

Clause 12 | Guarantee
12.1  WeAreLabels guarantees that the items to be delivered by us meet the usual requirements and norms which can reasonably be expected at the time of delivery and that they are fit for the purposes for which items of the same type are normally used in the Netherlands. If the items are to be used outside the Netherlands, you yourself need to check that the item is fit for use there.   

12.2  You need to check the delivered item at the time of its delivery, and certainly within the set ‘cooling-off’ period. When doing this, you should make sure that the quality and quantity of what has been delivered corresponds with what was agreed, and at least meets the requirements which apply to it in normal trade. 

12.3  Once the guarantee period referred to in Clause 9.1 has expired, WeAreLabels is entitled to charge all repair or replacement costs, including administrative, delivery and call out charges. 

12.4  The guarantee referred to in this clause lapses if the flaw has come about as a result of unwise or improper use or when, without written consent from WeAreLabels, you or third parties have made changes to the item in question or have used it for purposes for which the item is not intended.

Clause 13 | Disputes
13.1  All legal relationships to which WeAreLabels is a party are governed exclusively by laws of the Netherlands, even if an agreement is going to be executed in whole or in part abroad or if the other party to the legal relationship has a residence there.  The application of the Vienna Sales Convention is expressly excluded. 

13.2  WeAreLabels will always try to solve a dispute through constructive dialogue with you. If it’s not possible to find a solution that’s mutually satisfactory then the dispute must be brought before a competent judge of the Amsterdam District by the most ready party. 

Clause 14 | Copyright photos and images
14.1  All the photos and images which (will) appear on WeAreLabels are protected by copyright, regardless of the manner in which they’re disseminated or the form in which they’re delivered. It’s not allowed to publish or copy the photos or images in any way whatsoever without written consent from WeAreLabels. 

14.2  If you go ahead and use a photo or image anyway without prior written consent from WeAreLabels, you’ll be summoned to desist and a claim for damages will also be lodged against you.
